These Terms of Service (the "Terms") govern your access to and use of LOTUX ("LOTUX", "we", "us", or "our"), operated at lotux.io. By creating an account or using the Service, you agree to these Terms.

Important: Trading carries risk. Please read our Risk Disclaimer before using the Service.

1. What LOTUX is

LOTUX is a software-as-a-service automation tool. It lets you connect signal sources (such as TradingView alerts, external webhooks, and master trading accounts) to execution platforms that you own (MetaTrader 5, cTrader). LOTUX executes trades that you or your chosen signal source authorize.

LOTUX is not a broker, is not a financial advisor, is not a trading signal provider, and does not provide investment advice. LOTUX does not decide what to trade — you do, through the signals you connect.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract in your jurisdiction. You are responsible for ensuring that using LOTUX and the underlying trading activity is lawful where you reside.

3. Your account

• You are responsible for keeping your credentials secure and confidential
• You must provide accurate and up-to-date information
• You may not share your account with others or transfer it without our consent
• Notify us immediately at legal@lotux.io if you suspect unauthorized access

4. Plans, trial, and payment

• Free tier: limited features, no credit card required
• Basic plan: US$6 per trading account per month
• Pro plan: US$12 per trading account per month
• Pro trial: new users receive a 7-day Pro trial with no credit card required. At the end of the trial, your account reverts to Free unless you subscribe.
• Billing is monthly and recurring until you cancel. Cancellation takes effect at the end of the current billing period.
• Prices are in US dollars and exclude applicable taxes and payment processor fees.
• We may change prices with at least 30 days' notice before your next renewal.

5. Refunds

Because the Service is consumed continuously and each billing period is short, we do not offer pro-rata refunds for partial months. If you believe you were billed in error, contact legal@lotux.io within 14 days and we will review your case in good faith.

6. Your responsibilities

• Provide your own trading account at a broker of your choice
• Configure signals, risk rules, and strategy policies that you understand
• Verify that any external signal source you connect is legal and suitable for you
• Comply with your broker's and any proprietary firm's rules
• Comply with all laws applicable to your trading activity
• Maintain the technical infrastructure required on your side (EA, MT5/cTrader terminal, network connectivity) where applicable

7. Acceptable use

You may not use the Service to:

• Break any law or regulation
• Trade using credentials or signals you are not authorized to use
• Abuse broker or exchange systems (spam, latency attacks, market manipulation)
• Reverse engineer, decompile, or attempt to extract source code
• Probe, scan, or attack the Service infrastructure
• Resell or sublicense access without our written permission
• Submit malicious payloads, malware, or attempted exploits through webhooks or APIs

8. Third-party integrations

LOTUX integrates with third-party platforms (TradingView, MetaTrader 5, cTrader, Telegram, n8n, Zapier, Make, and others). These platforms are operated by their respective owners and have their own terms. We do not control them and are not responsible for their availability, accuracy, or actions.

9. Intellectual property

The Service, including software, designs, documentation, trademarks, and logos, is owned by LOTUX and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service during your active subscription, solely as permitted by these Terms.

10. Your content

You retain ownership of the signal payloads, strategy configurations, and other data you submit. You grant LOTUX a worldwide, non-exclusive license to process this data only to operate the Service on your behalf. We do not sell or use your content for advertising.

11. Service availability

We aim to provide high availability but do not guarantee uninterrupted operation. The Service may be temporarily unavailable for maintenance, upgrades, or reasons beyond our control (network outages, broker downtime, force majeure). We do not commit to a specific uptime SLA on Free and Basic tiers.

12. Trading risk disclosure

Trading financial instruments carries substantial risk, including the risk of losing all invested capital. LOTUX is a tool — it does not predict markets, does not guarantee profits, and does not reduce market or broker risk. You are solely responsible for your trading decisions and outcomes. 13. Disclaimer of warranties

To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted operation.

14. Limitation of liability

To the maximum extent permitted by law, LOTUX shall not be liable for:

• Trading losses or missed profits
• Decisions or actions taken by you or any signal source you connect
• Broker, prop firm, exchange, or third-party platform actions, failures, or outages
• Loss of data, goodwill, or business
• Indirect, incidental, consequential, special, or punitive damages

Our aggregate liability under these Terms in any 12-month period shall not exceed the total amount you paid to LOTUX during the preceding 12 months, or US$100 — whichever is greater. Some jurisdictions do not allow certain limitations; in those jurisdictions, the limitations apply only to the extent permitted.

15. Indemnification

You agree to indemnify and hold LOTUX harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your breach of these Terms, your violation of law, or your violation of any third-party right.

16. Termination

• You may cancel your subscription or delete your account at any time.
• We may suspend or terminate your account with notice if you breach these Terms, jeopardize the Service, or fail to pay. We may terminate immediately for serious breach or illegal activity.
• On termination, your right to use the Service ends. Provisions that by their nature survive termination (intellectual property, liability limits, governing law) continue to apply.

17. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced via email or in-product notice at least 14 days before taking effect. Continued use after the effective date constitutes acceptance.

18. Governing law and disputes

These Terms are governed by generally applicable international commercial principles without regard to conflict of law rules. Any dispute arising under or relating to these Terms shall first be addressed by good-faith negotiation via legal@lotux.io. If unresolved within 60 days, disputes shall be finally resolved by binding arbitration under the rules of a mutually agreed arbitral institution, seated in a mutually agreed neutral venue, and conducted in English. Nothing in this section prevents either party from seeking injunctive relief to protect its intellectual property or confidential information.

19. Trademarks

TradingView®, MetaTrader 5®, cTrader®, Telegram®, n8n®, Zapier®, Make®, Python®, OpenAI®, ChatGPT®, Anthropic®, and Claude® are trademarks of their respective owners. LOTUX is not affiliated with, endorsed by, or sponsored by any of these companies. Brand logos on the site indicate compatibility only.

20. Entire agreement

These Terms, together with our Privacy Policy and Risk Disclaimer, constitute the entire agreement between you and LOTUX regarding the Service. If any provision is held unenforceable, the remaining provisions remain in full force.
