Affiliate Program Agreement

This Affiliate Program Agreement (the "Agreement") governs your participation in the LOTUX Affiliate Program (the "Program"), operated by LOTUX ("LOTUX", "we", "us") at lotux.io. It supplements our Terms of Service and Privacy Policy. By accepting these terms in your dashboard, you agree to this Agreement.

1. Joining the Program

• You must have a LOTUX account, be at least 18, and be able to enter a binding contract.
• You join by accepting this Agreement. Your application is then reviewed by an admin (usually within 24–48 hours) before you can share your link and earn.
• We may approve, decline, suspend, or close an affiliate account at our discretion, including for fraud or abuse.

2. Referral tracking

• You receive a unique referral code and link. A referral is attributed when a new user signs up through your link and makes their first paid subscription.
• Attribution uses last-touch tracking via a cookie with a limited lifetime. If a user arrives through more than one affiliate, the most recent valid referral is credited.
• Self-referral is not allowed. Referring your own accounts, or arranging fake signups, voids the commission and may close your affiliate account.

3. Commission

• Commission is a percentage of the amount your referred customer actually pays (after any discounts), excluding taxes and payment-processor fees.
• Commission is recurring — you earn on the first payment and on each renewal the referred customer pays, for as long as their subscription stays active and attributed to you.
• Current rates depend on the product the customer buys and are shown in your dashboard (for example, individual apps and Pro plans earn different rates). We may set a custom rate for individual affiliates.
• We may change commission rates going forward with reasonable notice. Changes do not apply retroactively to commission already earned.

4. Holding period and approval

Each commission is held for 30 days after it is earned before it becomes approved and payable. The holding period lets us reverse commission if the underlying payment is refunded or charged back during that window.

5. Refunds, chargebacks, and clawback

If a referred customer's payment is refunded, disputed, or charged back, the related commission is reversed (clawed back). If it was already paid out, the reversed amount is deducted from your future earnings or payouts. Commission earned through fraud or policy breach is forfeited.

6. Payouts

• Minimum payout: US$50 in approved, unpaid commission.
• Currency: commission is tracked and paid in US dollars.
• Methods: Wise, Payoneer, bank transfer, or USDT (crypto), depending on availability in your country.
• Processing fee: a small processing fee (currently 1%) may be deducted from each payout to cover transfer costs. Third-party transfer fees, if any, are passed through.
• Payouts are reviewed and released by us. We pay from settled funds, so there may be a short delay between a commission becoming approved and the money reaching you.
• Convert to credit: instead of a cash payout, you may choose to convert approved commission into LOTUX credit to pay for your own plans, subject to the terms shown at conversion (including any bonus and an expiry window).

7. Taxes

You are solely responsible for any taxes on the commission you earn, including income tax and any reporting obligations in your country of residence. We pay commission gross and do not withhold income tax on your behalf. Where we are legally required to do so, we may ask you for identity or tax information before paying, and may withhold or pause a payout until it is provided.

8. How you may promote LOTUX

You may share your link honestly with your audience, community, or network. You may not:

• Send spam, or post in places where promotion is not allowed
• Make false, misleading, or guaranteed-profit claims about LOTUX or trading
• Bid on or impersonate LOTUX brand terms in paid ads, or pose as LOTUX
• Use cookie stuffing, fake traffic, bots, or any manipulation of tracking
• Offer unauthorized cash-back or rebates that we have not approved
• Break any law or any third-party platform's rules

9. Brand use

We grant you a limited, revocable right to use the LOTUX name and logo only to promote the Program, following any brand guidance we provide. You may not alter the logo, imply partnership or endorsement beyond the affiliate relationship, or register confusingly similar names or domains.

10. Suspension and termination

• You may leave the Program at any time. Approved, unpaid commission that is not subject to clawback remains payable once it reaches the minimum payout.
• We may suspend or close your affiliate account for breach of this Agreement, fraud, or abuse. Commission tied to fraud or breach is forfeited.
• Sections that by their nature survive (clawback, taxes, liability, governing law) continue to apply after termination.

11. Relationship and liability

You participate as an independent party, not an employee, agent, or partner of LOTUX, and you may not enter obligations on our behalf. To the maximum extent permitted by law, our liability under this Agreement is limited as set out in our Terms of Service.

12. Changes to this Agreement

We may update this Agreement from time to time. Material changes will be announced by email or in-product notice before they take effect. Continued participation after the effective date constitutes acceptance.
